This agreement is between WaitTime.com ("us", "we", "our") and you ("end user", "user", "subscriber"). By using, activating or paying for our Service, you hereby acknowledge that you have read these terms and that you agree to them. You also agree that you are of the proper legal age to enter into this agreement and be bound by our Terms of Service. These Terms of Service govern the use of the WaitTime.com app, website, and any other associated Service. Please read these Terms of Service carefully before using our app, website or any of our Services. If you do not accept these terms you are not allowed to use our Services.
Our Service
WaitTime.comis used to receive information about WaitTime.coms for businesses such as restaurants and salons and medical services like urgent care clinics and emergency rooms and any other businesses with waiting customers. WaitTime.com can also be used to make reservations at these services and businesses. Wait List's features may change from time to time without notice to our end users.
You accept that our Service cannot be expected to perform in every situation with every type of device including satellite phones, remote areas, mobile phones, and other devices as a result of carrier or technological restrictions. You accept that you may not hold WaitTime.com liable for any damages or problems occurred as a result of these service limitations or disruptions (see Limitation of Liability below).
Our service is intended for those 18 years of age or older; however, those who are 13 years of age and older can use our service, website or app with the supervision of a parent or guardian.
Promotional Offers
From time to time we may offer new subscribers promotional offers including free features, discounts and other incentives. WaitTime.com reserves the right to terminate any promotional offer at any time at its sole discretion. Unless explicitly mentioned under the terms of a specific promotion, former and current subscribers of our Service are not eligible for any new subscriber promotion.
Electronic Communications
When you use our website or Service, you communicate with us electronically and choose to receive information from us electronically. We communicate with you through the WaitTime.com service or through e-mail. You agree that any disclosures, agreements, or notices that we send to you electronically will satisfy any legal requirement that must be communicated in writing.
By providing WaitTime.com with your email address, you agree that you may be sent notifications relating to our Service including changes in our Terms of Service or Privacy Policy and any other notices required by law. You agree that these notifications satisfy any legal requirement that must be communicated in writing.
We reserve the right to send you promotional emails and electronic communications. You may choose to opt out of receiving promotional emails by following the unsubscribe instructions located in those emails. After opting out, you may still be sent non-promotional emails relating to your account. You may also send any requests to change your personal information or opt out by contacting us.

You are requested to provide WaitTimewith an e-mail address, phone number and password as well as other personal information in order to use our Service or website. You are required to provide accurate and current information about yourself when registering for our Service. You are solely responsible for maintaining the confidentiality of this information as well as any other security codes or passwords that are required in order to use our Service. You are solely responsible for restricting any unauthorized third party's access to this information and are required to change your login password periodically in order to maintain the security of your account.

WaitTime.com is not responsible for any losses or damages that result from the unauthorized use of your account, and you agree to indemnify WaitTime.com for any illegal use of your account. You may not use false information in order to create an account or impersonate any other person or entity. WaitTime.com reserves the right to terminate any accounts that it deems to be fraudulent.
Communications and Service Use

You are prohibited from using our Service for any fraudulent or abusive purpose including interfering with other users or preventing our Service from being accessible to other users. WaitTime.com reserves the right to terminate your account at any time if we believe that you have been using your account for any unlawful, abusive or fraudulent purpose. You agree indemnify WaitTime.com against any liability for any prohibited use of our Service. If WaitTime.com at its sole discretion believes that you have violated any of the aforementioned restrictions, we reserve the right to forward your personally identifiable information to the appropriate authorities for investigation.
Copyright
The information on our Service and website including text, images, designs, logos, video and audio clips, software and downloads, collectively referred to as "Content" is the intellectual property of WaitTime.com or the suppliers of the Content and is protected by international and United States copyright law. By agreeing to our Terms of Service you agree to never distribute, reproduce, modify, delete, remove, transmit, publish, create derivative works, or exploit the Content on our website or Service, partially or fully. You also may not authorize anyone else to do so.
Service Access and License
WaitTime.com grants you a non-exclusive, limited license to access our Service for your personal use. You agree that you may not modify any part of our Service without the express written consent of WaitTime.com. This license does not allow the commercial use or resale of our Service or our Content; the business or product listings, prices, or descriptions and any other content found in our Service; or any account information. You are prohibited from using any data mining service, robot, spider, software, or automated devices to download, store, reproduce or distribute any Content found in our Service or on our website.
You agree that you may not sell, resell, copy, duplicate or reproduce our Service for any commercial purpose without the written consult of WaitTime.com. You are prohibited from using any meta tags or hidden website text with our Service name or trademarks without our express written consent. You are prohibited from using any framing techniques in order to enclose our logo, trademark or proprietary information such as our text, images, forms, and page layout. Linking to our website or service is allowable assuming that the link does not describe WaitTime.com or its Services in a misleading, slanderous or offensive manner. WaitTime.com reserves the right to request the removal of any link that we believe contains offensive, misleading derogatory, or inappropriate content or references to WaitTime.com or our Service.
Charges and Payments
You are required to provide a valid credit card or checking account information when using any paid features of our Service. You authorize WaitTime.com to automatically charge your credit card or bank account any amounts that are applicable to your use of the paid features of our Service. Any charges and credits will be available in an online billing statement that you can download from our website. If your credit card or checking account information changes at any time, you are required to update it on WaitTime.com or notify us at once. WaitTime.com is not responsible for any overdraft charges or other fees imposed by your bank or financial institution for insufficient funds.
You are responsible for any applicable federal, state, or local taxes as well as utility, sales, use or excise taxes that are associated with the use of our service. These tax amounts are in addition to any payments that you make for the use of our Service and are billed to your credit or debit card or checking account. If you are exempt from these taxes, you are obligated to provide information proving that you are exempt.
If we determine that your payment method has become invalid, we reserve the right to suspend your account or restrict your Service until a valid payment method has been added back to your account.
Prices and Price Changes
Our services are free for guest users. Business may be required to purchase a plan. Our prices are posted on our website and any changes to our prices may occur from time to time. Prices may be decreased without any advance notice. A seven (7) day notice will be provided for any increases in pricing, after being published on our website or transmitted through e-mail or our Service.
Service Cancellation
You may choose to cancel our Service at any time according to the procedures listed on our website. You are liable for any taxes, fees, and charges that have been accrued at the time of Service cancellation, and you authorize WaitTime.com to process those charges on any payment information that you have provided us with. If we are unable to process these payments, we may take collection activity and you are responsible for any associated expenses incurred including court costs, legal fees and collection fees.
Updates
WaitTime.com may make updates to our Service from time to time for free or for an additional fee, based on our sole discretion. Updates can include any fixes or corrections, new versions or feature additions to our service. Notwithstanding any other terms in this agreement, WaitTime.com has no obligation to continue producing new versions of our service or updates.
Third Party Content
WaitTime.com may permit third parties to publish content on our website or on our Service through the use of Application Programming Interfaces (APIs) including by not limited to copy, graphics, reviews, promotional information and pricing. Mistakes in pricing or typographical mistakes may occur on our Service, and WaitTime.com cannot guarantee the pricing of any particular promotional offer. WaitTime.com is not the publisher of this content and assumes no liability for any third party promotional offers or content.

IF YOU ARE NOT SATISFIED WITH THE WAITTIME.COM SERVICE, YOUR SOLE REMEDY IS TO DISCONTINUE USING THE SERVICE. SOME OR ALL OF THE ABOVE MENTIONED LIMITATIONS OR EXCLUSIONS MAY NOT BE APPLIABLE TO YOU BECAUSE CERTAIN STATE LAWS PROHIBIT LIMITATIONS ON IMPLIED WARRANTIES OR THE LIMITATION OF CERTAIN DAMAGES.
Indemnity
You agree to indemnify and hold WaitTime.com and its affiliates, officers, suppliers, employees, agents, directors, licensors and partners and any service provider or agent who furnishes our Services to you harmless from damages or claims resulting from your use of our Service. You agree to indemnify WaitTime.com for any use of our Service without limitation, any other person's use of our service under your account, any actual or alleged violation of any applicable law or this Agreement, or any other property or right of any other entity or person. You agree that WaitTime.com is not responsible for any third party claims against us that result from your use of our Service. You agree to reimburse WaitTime.com for any costs resulting from any such claims including court and attorney's fees, using the claims are based on WaitTime.com's gross negligence.
Changes to this Agreement
WaitTime.com may make changes to this agreement from time to time. You are obligated to check these Terms of Service at regular intervals for any changes to this agreement. Changes are posted in the Terms of Service section of the WaitTime.com website and by posting changes to our Terms of Service, notice will be considered to be received by you. Any updates to our Terms of Service are effective and binding on the date that they are posted. If you continue to use or pay for our Service, you agree to any changes to our Terms of Service.
